Penalties for a DUI Conviction in Atlanta

Drunk driving laws and penalties

In Atlanta, driving under the influence (DUI) of drugs or alcohol is a serious crime that carries harsh penalties.  Anyone operating a motor vehicle while under the influence of any substance that impairs the ability to drive can be charged with DUI.  In the case of alcohol, a blood alcohol concentration (BAC) of 0.08 percent is the legal limit, but even an impaired driver with a lower BAC level can be charged.  Driving with any form of an illegal drug in your system, no matter how small the quantity, is automatic grounds for a DUI.  It could make a big difference to your case to have an Atlanta drunk driving attorney on your side.

Atlanta DUI first offense within ten years

A Georgia DUI first offense carries these penalties:

  • A minimum of 24 hours in jail
  • Up to12 months probation
  • A $300 to $1,000 fine
  • A minimum 40 hours of community service
  • 12-month license suspension
  • Enrollment in an alcohol or drug use risk reduction program
  • An alcohol and/or drug clinical evaluation
